Lieutenant Colonel Nicholas S. Henry

Lieutenant Colonel (LtCol) Henry began his military career as an enlisted Marine, in January of 2002, at MCRD Parris Island. In March of 2003 LtCol Henry, then a Lance Corporal deployed twice in support of Operation Enduring Freedom and Operation Iraqi Freedom. LtCol Henry received a Navy Achievement Medal (NAM) for developing a training program for the Iraqi National Guard in Hit, Iraq and was promoted to Corporal while deployed. In September of 2004, LtCol Henry returned to the University of Dayton and completed his undergraduate and master degrees, graduating with a Bachelor of Arts in Accounting and a Masters of Business Administration.

Following completion of Officer Candidate School (OCS) and commissioning as a Second Lieutenant, during the summer of 2005, LtCol Henry enrolled at the John Marshall Law School in Chicago Illinois. In May of 2008 LtCol Henry graduated from John Marshall and received his JD and shortly after, passed the Illinois State Bar. While awaiting his Bar Exam results and a seat at The Basic School (TBS), LtCol Henry also completed a Masters of Law Program in international business and trade law at John Marshall Law School, receiving his first LLM. During this time LtCol Henry, founded a legal clinic to assist veterans in filing claims with, and appealing decisions of, the Department of Veterans affairs, for which he was awarded the Outstanding Volunteer Service Medal.

Following NJS and receiving qualifications and certification from The Judge Advocate General (JAG) of the Navy, LtCol Henry returned to Combat Logistics Regiment 37 and took over as the Officer in Charge, Legal Assistance Branch at the Legal Services Support Center. In November of 2010, LtCol Henry was assigned to the Defense Services Organization (DSO).

As a defense counsel, LtCol Henry represented 94 military clients pending trials by courts-martial and administrative separation boards, including 15 contested courts-martial with members, eight of which resulted in full acquittals. He counseled in excess of 400 Marines on their rights concerning the non-judicial process and general legal questions. During 2011, LtCol Henry was named the Defense Counsel of the Year for the Pacific Region. He was awarded an impact NAM for this accomplishment.

LtCol Henry returned to NJS as an instructor in October of 2012. He was assigned as the Trial Advocacy Division Officer and charged with revamping the Mock Trial Exercises for the Basic Lawyer Course (BLC). He also served as an instructor in the MILJUST department regarding courses in evidence and procedure. LtCol Henry was also assigned as the Deputy Program Manager for Online Legal Education (OLE). He was charged with the development and delivery of online training for the entire Navy, Marine Corps, and Coast Guard legal communities.


LtCol Henry was selected for Major in December of 2015. He was also selected for the Special Education Program – LAW. LtCol Henry was awarded and LLM in Trial Advocacy from The California Western School of Law in May of 2016. In June of 2016, LtCol Henry reported to Marine Corps Base Hawaii as the Complex Trial Counsel (CTC). The CTC is the lead prosecutor for all sexual based offenses and many other felony level offenses for the Hawaiian Islands. In this capacity he worked closely with NCIS, CID, other Federal Agencies, and Commanders. LtCol Henry spent three years as the CTC. LtCol Henry was extended an additional year at this duty station to serve as the Senior Trial Counsel (STC). As the STC, LtCol Henry oversaw all the prosecutions and was responsible for training and mentoring the junior prosecutors. During this tour, LtCol Henry was selected as the winner of the 2018 Brigadier General Michael E. Rich Litigator of the Year Award. In 2020, LtCol was selected to serve as a Military Judge at Marine Corps Base Camp Lejeune. In three years as a Military Judge, LtCol Henry presided over 95 General and Special Courts-Martial.

LtCol Henry is entitled to wear the Meritorious Service Medal with one gold star, Navy-Marine Corps Commendation Medal, Navy-Marine Corps Achievement Medal with three gold stars, the Combat Action Ribbon, the Presidential Unit Citation, the Navy Meritorious Unit Commendation, the National Defense Service Medal, the Marine Corps Reserve Medal with bronze star, the Armed Forces Reserve Medal with “M” Device, the Iraq Campaign Medal, the Sea Service Deployment Ribbon with three bronze stars, the Global War on Terrorism Expeditionary Medal, Global War on Terrorism Service Medal, and the Outstanding Volunteer Service Medal.
